63- year-old man gets life imprisonment under POCSO Act for raping minor girl in Assam
Guwahati: A local court in Assam’s Dhubri district on November 23 sentenced a 63-year-old man to life imprisonment for sexually molesting a minor girl under the POCSO Act.
Notably, the POCSO Court in the Dhubri district on November 23 thoroughly reviewed the case file before handing the guilty individual, identified as Amjad Ali, the exact sentencing amount.
He is accused of sexually assaulting a nine-year-old child who lives in the Tamarhat area in the Dhubri district.
Ali, who is over 60, took advantage and did a horrific act by raping the young girl when no one was home.
The criminal raped the victim, leaving her with permanent trauma and threatening her not to tell anyone about what happened.
Uttam Kumar Sarkar learned that the Special Public Prosecutor claimed that Ali raped the victim, a nine-year-old girl, while she was washing clothes in her backyard before taking her to his house and raping her there.
Later, once the victim had told her family about the incident, the family members and other villagers went to look for the culprit and capture him. They then filed a case with Tamarhat Police station.
The Tamarhat Police Station investigated the situation after filing Case No. 11/2022 U/S- 376 AB IPC R/W Sec 6 of POCSO Act against the accused, Amjad Ali, based on the aforementioned allegation.
After the investigation was complete, the case’s IO Jayanta Kumar Das and then-OC Tamarhat submitted a charge sheet under the POCSO Act against the accused Amjad Ali, and the case was subsequently filed as a Special Case in the year 2022.
Meanwhile, the Additional Sessions Judge cum Special Judge, POCSO, on her judgment dated 23/11/2022 stated that “In the instant case, the convict-accused has raped a young minor girl who was helpless, defenceless, vulnerable and an easy prey.”
After hearing from both sides and receiving a favourable forensic report, the Additional Sessions Judge and Special Court (POCSO) Polly Katoki in Dhubri issued an order that convicted Amjad Ali to life imprisonment and fined him Rs. 50,000.
A punishment of an additional six months in prison has also been imposed under Section 6 of the Protection of Children from Sexual Offenses (POCSO) Act.
