Mizoram: CADC Leader Urges Action Against Dual Office Holding Allegations
Northeast Desk, 8th January: DoyMoy Daveng Chakma, Member of the District Council and Leader of CADC ZPM Legislature Party wrote letters to the Mizoram Governor and the Speaker of the Mizoram Legislative Assembly on January 8. The letters seek the removal of disqualification for Rasik Mohan Chakma, the current Chief Executive Member (CEM) of Chakma Autonomous District Council (CADC), concerning alleged dual office holding.
Rasik Mohan Chakma, serving as the CEM of CADC and a Member of Legislative Assembly (MLA), is accused of violating Rule 11 (1) of the CADC (CCB, etc) Rules, 2002, and The Mizoram State Legislature Members (Removal of Disqualification) (Amendment) Act, 2006.
DoyMoyDaveng Chakma, in his communication with the Governor, highlights the alleged violation, emphasizing that holding both positions simultaneously contradicts Rule 11 (1) of the CADC (CCB, etc) Rules, 2002. This rule mandates a member to resign from either the District Council or Legislative Assembly within 21 days of official gazette publication, failure of which leads to automatic vacancy in the District Council.
The complaint also points out the omission of Article 4 in the schedule of the principal act under The Mizoram State Legislature Members (Removal of Disqualification) (Amendment) Act, 2006. This omission prohibits an MLA from holding office in any Autonomous District Councils and the President, Vice-President, or Member of any village council in Mizoram.
DoyMoy Daveng Chakma urges the Governor’s immediate intervention to enforce the mentioned rules and acts against Rasik Mohan Chakma, citing constitutional safeguarding as imperative.
