Assam: Supreme Court Issues Notice on Plea Challenging Gauhati High Court’s Reversal of Dhemaji Bomb Blast Convictions

Guwahati, 12th January: The Supreme Court has sought a response from the concerned respondents on a petition challenging the Gauhati High Court’s decision to overturn the trial court’s judgment convicting five accused, including ULFA members, in connection with the Dhemaji Bomb Blast on August 15, 2004. The blast resulted in the tragic loss of ten children and three women.

A bench of justices J K Maheshwari and Justice Sudhanshu Dhulia issued the notice to respondents based on the plea filed by the State of Assam. The Gauhati High Court, on August 24, 2023, had reversed the conviction of the accused under various sections of the Indian Penal Code, Explosive Substances Act, and the Unlawful Activities (Prevention) Act, 1967 (UAPA).

The petition argues that the High Court erred in rejecting Jatin Dowari’s confessional statement, citing a retraction after an inordinate delay of ten years. It also contends that the High Court overlooked the prosecution sanctions granted under the UAPA, which were duly submitted along with the charge sheet.

The appeal aims to reinstate the trial court’s judgment that held the accused responsible for the tragic incident.
