Gauhati High Court Orders Compensation for Demolished Homes in Assam’s Nagaon
Guwahati, 4th May: In a significant development, the Gauhati High Court, during a PIL (Public Interest Litigation) hearing numbered PIL (Suo Moto)/3/2022, has issued orders for compensation to individuals affected by the demolition of homes in Nagaon, Assam. The case underscores the challenges faced by those impacted by the state government’s demolition drive.
Represented by Rashida Khatun, widow of the late Safiqul Islam, the petitioners brought forth their grievances seeking justice for the demolition of their residences. The respondents in the case include the State of Assam, various government officials, and law enforcement agencies.
During the hearing, Mr. D.K. Sarmah, Additional Senior Government Advocate of Assam, apprised the court of the actions taken by the State Government following the submission of a report by a One Man Enquiry Committee. Sarmah informed the court that the Political (A) Department of the Government of Assam had directed the Revenue & Disaster Management Department to assess the losses incurred due to the demolition of six houses.
Assuring the court of the state’s commitment to address the issue, Sarmah stated that once the assessment report is finalized, the affected individuals would receive compensation for their losses. Additionally, H.K. Das, standing counsel for the Gauhati High Court, presented orders issued by the Political (A) Department of the Government of Assam, demonstrating the state’s proactive engagement with the matter in March and April 2024.
In response to these developments, the court directed the matter to be listed for further compliance reports after a period of three weeks, indicating a proactive approach towards resolving the grievances of the affected individuals.
