Namchi District Magistrate Issues Prohibitory Orders for Upcoming 2024 Bye Election

Itanagar: The District Magistrate of Namchi District has issued an order under Section 163 of the Bharatiya Nyaya Sanhita, 2023, to ensure public peace and order during the 2024 Bye Election for the 11-Namchi-Singhithang Assembly Constituency in Sikkim. The directive is effective immediately and will remain in force until the election process concludes, unless revoked earlier.

The order restricts the assembly of five or more individuals for activities such as sloganeering, protests, or rallies without prior permission from the competent authority. The possession and transport of firearms or weapons, including swords and knives, are also prohibited unless for specific purposes like domestic, agricultural, or industrial use.

Vehicular rallies involving more than ten vehicles are banned unless the vehicles are used for law enforcement or poll-related duties. Election campaigns that require the use of vehicles will need express authorization from authorities.

Additionally, any form of communication, including verbal, printed, or digital, that could incite violence or hatred among different social groups is forbidden. The use of loudspeakers and slogans after 5 PM without permission is also prohibited.

To enhance security, cross-border movements are restricted, with all entry and exit from Namchi District limited to designated checkpoints. This restriction does not apply to government officials performing their duties.

Violators of the order will face punitive actions under Section 223 of the Bharatiya Nyaya Sanhita, 2023, which could include penalties or legal action. The District Magistrate’s office emphasized that these measures are necessary to ensure the peaceful conduct of the election.

The order reflects the district administration’s commitment to maintaining law and order during the crucial election period.
