Arunachal Pradesh Assembly Passes Bill Seeking to Transfer Pending Civil Suits to Other Courts

Guwahati: A bill requesting the transfer of civil lawsuits now pending in deputy commissioners’ courts to other courts was approved by the Arunachal Pradesh Assembly.

This was one among the two bills passed in the assembly on Wednesday.

The second draught suggests changing the Goods and Services Tax (GST) in accordance with changes made to the relevant central law.

The Arunachal Pradesh Civil Courts (Amendment) Bill, 2022 was introduced by Chief Minister Pema Khandu and aims to provide for the transfer of civil cases currently pending in the courts of deputy commissioners to junior and senior division civil judges, district and additional district judges, in accordance with their territorial and financial jurisdiction.

It would enable the local administrative officers to facilitate and refer issues back to the village authority for resolution, restoring the natural connection between the village authority and local administrative officers.

If the parties to the case agreed, it would also allow the inter-village customary court—or whatever name it may go by—to resolve the appeal out of the order granted by village authorities without immediately contacting the regular courts.

According to the bill’s statement, the new legislation will reduce the workload for normal courts.

Meanwhile, Deputy Chief Minister Chowna Mein, who also oversees taxes, excise, and narcotics introduced the Arunachal Pradesh Goods and Service Tax (1st Amendment) Bill, 2022.

The bill was passed with the intention of allowing the state government to impose and collect tax on intra-state supply of goods or services or both.
