Delhi CM Arvind Kejriwal’s Judicial Custody Extended, Supreme Court Weighs Bail Plea
National Desk, 7th May: A Delhi court has extended the judicial custody of Delhi Chief Minister Arvind Kejriwal until May 20, following a hearing in the Supreme Court regarding his bail plea application.
During the proceedings, the Supreme Court acknowledged Kejriwal’s status as an elected Chief Minister, particularly with elections looming. Describing the situation as extraordinary, the court emphasized that Kejriwal is not a habitual offender.
The bench, comprising Justices Sanjiv Khanna and Dipankar Datta, deliberated on Kejriwal’s petition challenging his arrest by the Enforcement Directorate on March 21 in connection with the Delhi liquor policy case.
Senior lawyer Abhishek Manu Singhvi, representing Kejriwal, addressed the court’s concerns regarding the CM’s potential actions if released on interim bail. Singhvi assured that Kejriwal would not be involved in the excise case and would continue his duties as a sitting Chief Minister.
However, the bench clarified that if Kejriwal were released, he should refrain from performing any official duties due to potential cascading effects. The court also noted that Kejriwal’s participation in the Lok Sabha election campaign is essential.
In response, the Enforcement Directorate opposed the court’s suggestion, arguing that it could set a precedent. They questioned whether all MPs and MLAs facing prosecution should be released on bail. Singhvi has been tasked with addressing these concerns raised by the Enforcement Directorate.
