Delhi High Court Grants Transit Bail to Man Accused of Inciting Communal Hatred Over Nagaland Social Media Post

Kohima: The Delhi High Court has granted a two-week transit bail to Akash Tanwar, who was booked for allegedly posting a video on social media inciting communal hatred against the people of Nagaland.

Justice Amit Mahajan, while examining the case, noted that the content of the video, though offensive, did not appear to target individuals based on caste, as the FIR lodged in Nagaland under the SC/ST Act suggests.

Tanwar was arrested in Delhi in November 2023 following a complaint that his video was offensive to the Naga community.

However, the court remarked that the video seemed to malign the people of Nagaland but lacked evidence that the remarks were directed at them because of their scheduled caste or tribe status.

The High Court also provided Tanwar with the opportunity to approach a court of competent jurisdiction in Nagaland for further legal proceedings and denied his request to quash the FIR, directing him to seek relief through appropriate channels.

This decision allows Tanwar temporary relief while he seeks legal remedies, but the case continues as both the Delhi and Nagaland courts hold jurisdiction over the matter due to the nature of the offense.
