Landmark Court Decision in Assam: False FIR Filers to Face Legal Action
Guwahati, 20th March: In a historic ruling in Assam, the Additional Sessions Judge cum Special Judge, POCSO, Dhubri, authorized the bench assistant of the court to lodge a complaint against a complainant for filing a false First Information Report (FIR) under the POCSO Act in Dhubri.
On October 13, 2023, an FIR was lodged bearing special case no. 371/2023 at Agomoni police station in Dhubri district, alleging serious crimes including rape and blackmail against the accused, Alomgir Rahman. Rahman was detained on November 30, 2023, and incarcerated until January 30, 2024. However, during the ongoing judicial trial, the victim’s father, Kudrat Ali, made a remarkable statement in court, revealing that he filed the FIR out of anger because the accused frequently proposed marriage to his daughter, and now wishes to halt the judicial procedure.
In response to these revelations, bench assistant Saurav Karmakar submitted a written complaint under Section 22 of the POCSO Act against Kudrat Ali for filing a false FIR against Alomgir Rahman, as directed by Mamta Bhadani, Additional Sessions Judge cum Special Judge, POCSO, Dhubri. Consequently, a case has been filed against Ali, bearing Chief Judicial Magistrate (CJM) case no. 3366/2024, in accordance with relevant penal statutes.
Rituparna Guha, the special public prosecutor, and Jonali Devi, the investigating officer WSI(P), will lead the case’s witness testimony. The court’s decision reflects a stern stance against false accusations, especially in cases involving sexual assault, and underscores the importance of upholding the integrity of the legal system.
The court’s actions aim to prevent the misuse of laws meant to protect survivors of sexual assault and to ensure that justice is served fairly and impartially. False allegations not only undermine the seriousness of the crime but also inflict irreparable damage to the reputation and honor of the accused.
The case, under CJM case no. 3366/2024, will proceed against Kudrat Ali for filing a false FIR against Alomgir Rahman, highlighting the judiciary’s commitment to upholding justice and truth in legal proceedings.
