Gauhati HC Dismisses CBI Probe into 2016 Assam Rifles Firing Incident

Guwahati: A Central Bureau of Probe (CBI) investigation into the shooting death of two people who were allegedly ULFA cadres in Miao, Arunachal Pradesh, on December 14, 2016 by Assam Rifles soldiers was rejected by the Gauhati High Court.

However, concurrently, the Central Government was ordered to give each of the relatives of the two victims Rs. 4 lakhs in compensation within a month by a Division Bench of the High Court made up of Chief Justice RM Chhaya and Justice Soumitra Saikia.

The two persons were Deep Moran alias Deepjyoti Chutiya and Anupam Moran alias Nagamen, a minor boy.

The order was issued in response to a Writ Petition submitted by the mothers of the deceased, who asked for a CBI or legal investigation into the occurrence, payment of damages to the deceased’s heirs, and prosecution of the security officers at fault.

The governments of Arunachal Pradesh and Assam, along with the counsels for the Assam Rifles, provided a variety of documents to support the claim that the 11 new recruits who were staying in the Changlang district of Arunachal Pradesh while travelling to Myanmar to join the outlawed ULFA included the two killed youths.

The attorneys said that after Assam Rifles members encircled the suspect house as a result of a tip-off, a shooting incident took place. They further claimed that Assam Rifles men shot Deep Moran and Anupam Moran after they disobeyed orders to stop and instead sought to flee the security perimeter.

The Division Bench observed that, in accordance with an earlier order given by a coordinating Bench of the High Court, the District Judge of Dibrugarh had previously conducted a comprehensive investigation into the subject.

The Division Bench ordered the appropriate authorities to accelerate their investigations on the basis of separate FIRs filed earlier by the relatives of the two deceased persons, while rejecting a CBI investigation into the incident.
